A couple of 1985 batch IPS officers are likely to be empanelled as ADG in the Government of India this month.

No IAS officer interested in joining at Director/Dy Secretary level post in GoI

No Indian Administrative Service (IAS) officer has shown interest in joining central deputation at Director/Deputy Secretary level. The Department of Personnel and Training (DoPT) has not received any application for deputation from the officers.

No decision on new DGCA

The Government has so far not taken any decision on the appointment of new Director General of Civil Aviation (DGCA). Four Joint DGs who were interviewd for the post could not make it. Present DGCA B S Bhullar has been given one months extension.

Factually incorrect

There is a constant refrain in some quarters that judicial appointments are being delayed in a stand off between the executive and the judiciary. The judiciary sees the government as interfering in appointments which it sees as its domain. This is factually incorrect. The position of primacy in judicial appointments currently being enjoyed by the judiciary is neither traditional nor mandated, it is actually a judicially determined position and does not owe its existence to constitutional provisions or intent. It is only a consequence of the withering away of the executive even as the judiciary grew in power and public esteem over the past two decades or so. It is nobody's case that the judiciary should not be independent. However, merely because it adjudicates between disputes between authorities, it cannot don the cloak of superiority to those authorities. The fine balance between institutions has to be maintained and so does the balance of power. It is to the credit of the executive that they are not displaying feet of clay any more. In retrospect, this could be one of the lasting contributions of the current dispensation.

Should Govt change its style of functioning ?


In the Judges Conference PM has very aptly pointed out that Govt is the biggest litigant. If he is saying so it means that yes it is. Should Govt allow this to continue or change its style of functioning by way of adopting best practices not merely for photo ops or to grant to grant some certificates in an annual function. What DoPT and other such similar organisations where human interface with personnel matters are dealt with resulting in court cases can create a space on their website itself to voice concern of the employees and its actual position officially which can reduce a lot of litigation when issues being addressed to in an open manner.

Accounting services should be merged


Yes accounting services should be merged into one. It is the need of hour but on the same time useless irrelevant outdated technical services like Indian Telecom Service must be abolished. An appropriate step was taken by last NDA government by declaring Indian Telecom Service as Surplus cadre but surprisingly a surplus cadre was allowed to recruit more than 14% of cadre strength(463) in a single year in 2010. Although it sounds fishy but today government is bearing their salaries whereas other genuine service Indian Radio Regulatory Service is still struggling to get their legitimate dues like apex post. Timing of this 2010 recruitment and period of scams also coincides, rest is best.Maker & checker concept in USOF does not apply as PSUs manned by ITS were also beneficiaries and IP&TAFS was the only EXCLUSIVE Government cadre at that time in DoT. If still there was something fishy then why this issue was not raised by C&AG or other agencies. In any case today only monitoring work is there. Yes, Accounting people are clerks but these clerks of IP&TAFS are the largest NON TAX REVENUE ASSESSOR & Collector of the government of India today.

DoT is no longer the Service provider in our liberalised India. The services functions are corporatized and many other private players are operating in this vast and dynamic field. The primary function of DoT has become regulatory and Revenue assurance.

The moment all the technical operations of DoT was converted into BSNL (a PSU), DoT no longer remained a technical department. So claiming DoT as technical department is not valid. It is simple logic.

Further, Regulatory functions are now overseen by TRAI, which is a statutory body created by an act of Parliament. So after TRAI got created in 1997 and BSNL got created in 2000, it is anyone's guess that what DoT major functions are mostly Revenue and Finance related only.

If in future, railways are privatised, the ministry of railways will no longer be a technical department. Most of the functions of railways will become Finance and revenue related.

If you see the main functions of DoT as of now, which are Spectrum auctioning, Licence fee collection, Spectrum charges, Audit functions, USOF management, all are related to Finance and Revenue. Recently, CAG audit has said that there is a revenue loss of Rs. 12000 crore (only for 4 financial years) to Government of India because of improper assessment of revenue. Also no one can forget the 2G scam which shook the nation. All these are happening because DoT is still considered as a technical department and no due care is given to Finance/Revenue people.

If you see the Non-Tax revenue of Government of India, telecom revenue is having the biggest share (This year's budget has a revenue target of nearly 98000 crores only for Telecom revenue). If this does not make DoT, revenue cum finance department, I am amazed what else will make.

Moreover, the last two pay commissions have endorsed this and in fact, 6th PC even recommended to disband the technical service ITS.

The IP&TAFS Group A organized services which are recruited through the most coveted and toughest Civil Services Exam have been manning the Finance wings of DoT. It is a fact that many top rankers chose this service with zeal to work in the most dynamic field in the world now, Telecommunications. Almost 90% of the new IP&TAFS recruits are engineers and have prior work experience and our Government believes that they have the ability and creativity to transform the department.

Missing records cannot be used as an excuse to deny information

The appellant stated that he joined the service in 1981 and is on the verge if retirement. He claimed that he has not got even a single promotion during his entire service period, though he is eligible as per rulers. He sought certain documents claiming that due to non-availability of the said documents, the appellant could not get his senior grade and selection grade. The PIO stated that information sought by the appellant is not available. The CIC observed that unless proved that record was destroyed as per the prescribed rules of destruction/ retention policy, it is deemed that record continues to be held by public authority. The CIC pointed out that by practice, 'missing file' cannot be read into as exception in addition to exceptions prescribed by RTI Act as it amounts to breach of Public Records Act, 1993 The CIC directed the PIO, Mr. the Principal and the Asst. Registrar to show-cause why maximum penalty should not be imposed upon them for not providing the information to the appellant and why disciplinary action should not be recommended against them. Further, the public authority was directed to explain why compensation should not be paid to the appellant for harassing him by not providing the requisite information for a long time.

Comments

In many government offices, the quality of record keeping needs a massive overhaul. As per Public Records Act, 1993 action can be initiated for any loss of public records and is punishable with imprisonment up to a term of five years or with fine or both.
