at a roadside Tea shop that has a Shoe Shine next to it. As I sip my
Tea and get my shoes shined I start chatting with the Tea Shop Owner

by Official Secrets Act as Parliamentarians . Silence thereafter is

SC orders not implemented by elite bureaucracy
Ref comments of Chandra Shekhar. If he has police reforms in mind, he
should understand Supreme Court orders thereon have not been implemented
by the elite bureaucracy. We have the dubious distinction of still implementing
the British Laws. With such rampant shamelessness nothing will change.

JNU students at it again
JNU students were at it again-insulting India and Democracy. This is
no freedom of speech -burning Prime Minister's effigy as Ravana. By
doing this they have also insulted the people of India who elected him
to lead this country for five years. They dared to do so because no
harm came to them for their anti-national acts on Feb 9 when they joined
the Kashmiri separatists' chorus of 'Azadi' as also idolized the terrorists
like Afzal Guru and others. Even the High Court has shown lot of indulgence
to them by granting the guilty students permanent bail for all that
their criminal acts. It is high time JNU is purged of these elements
who are there to indulge in pro-enemy acts while following a permanent
student career at taxpayers' cost. Their highly subsidised fee and Board
and lodging in the University hostel only encourages them to live in
the campus for years not for any academic pursuit but to just indulge
in mischief and political propaganda of their 'Commis' friends.

Missing records cannot be used as an excuse to deny information
The appellant stated that he joined the service in 1981 and is
on the verge if retirement. He claimed that he has not got even
a single promotion during his entire service period, though he
is eligible as per rulers. He sought certain documents claiming
that due to non-availability of the said documents, the appellant
could not get his senior grade and selection grade. The PIO stated
that information sought by the appellant is not available. The
CIC observed that unless proved that record was destroyed as per
the prescribed rules of destruction/ retention policy, it is deemed
that record continues to be held by public authority. The CIC
pointed out that by practice, 'missing file' cannot be read into
as exception in addition to exceptions prescribed by RTI Act as
it amounts to breach of Public Records Act, 1993 The CIC directed
the PIO, Mr. the Principal and the Asst. Registrar to show-cause
why maximum penalty should not be imposed upon them for not providing
the information to the appellant and why disciplinary action should
not be recommended against them. Further, the public authority
was directed to explain why compensation should not be paid to
the appellant for harassing him by not providing the requisite
information for a long time.
Comments
In many government offices, the quality of record keeping needs
a massive overhaul. As per Public Records Act, 1993 action can
be initiated for any loss of public records and is punishable
with imprisonment up to a term of five years or with fine or both.
