Will Tatas face a legal battle ?
With Shapoorji and Pallonji Group, the majority shareholder in the Tata
Group, terming Cyrus Mistry's ouster from Tata Sons as illegal, speculations
are rife that Tatas are heading for a legal battle. The group headed
by Pallonji Mistry, father of Cyrus, has said that the decision to remove
Cyrus was not unanimous and it will contest.
What lead to Cyrus Mistry's ouster ?
Tata Sons, it is believed, was unhappy with Cyrus Mistry's approach
of shedding non-profit businesses and concentrating only on cash cows.
This includes doing away with the group's steel business in Europe,
Who decided Cyrus Mistry's ouster ?
Sir Dorabji Tata Trust and Sir Ratan Tata Trust -- two trusts chaired
by Ratan Tata -- have powers to appoint or remove a Chairman. Both trusts
combined together hold 66 percent stake in Tata Sons, the holding firm
of Tata group of companies.
Decision to remove Cyrus Mistry was not unanimous
Out of the nine board members of Tata Sons, eight voted out of which
six voted for Cyrus Mistry's ouster as Chairman of the Company.
Who will replace Cyrus Mistry ?
Who will step in the shoes of the outgoing chairman of the Tata Group,
Cyrus Mistry ? If industry insiders are to be believed, there are atleast
half a dozen strong contenders.
Indra Nooyi to be Tata group's new Chairman ?
Indra Nooyi of Pepsi, could be a strong contender to replace Cyrus Mistry
as the Tata group's new Chairman. Ratan Tata is said to be highly impressed
by her.
Will Noel Tata make it to the top ?
Noel Tata of Tata International, is also a contender to replace Cyrus
Mistry as the Tata group's new Chairman. His chances are bright given
Ratan Tata's reported inclination for having someone from the family
at the helm of the affairs.

N Chandrasekaran, TCS CEO, could also be a contender to replace Cyrus

Will Amit Chandra replace Cyrus Mistry ?
Amit Chandra, who heads Bain Capital in India, could also turn out to
be a dark horse for the post of Chairman of Tata Group. He is also a
member of the search committee formed by Tata Sons to select the next
chairman.

Ishaat Hussain, former CEO of Tata Group, may also be a contender to
replace Cyrus Mistry as the Tata group's new Chairman.

Payment of final dividend by AAI for year

Airports Authority of India (AAI) is a consistently profit making Public
Sector Undertaking and paying Dividend to the Government of India. AAI
achieved a record turnover of Rs. 10825 crores, Profit Before Tax (PBT)
of Rs. 3697 crores and Rs. 2537 crores as Profit After Tax (PAT) during
the year 2015-16. AAI paid a Dividend of Rs. 761.21 crores for FY 2015-16
to the Government of India. AAI presented a cheque amounting to Rs.
482.21crores as Final Dividend for the FY 2015-16 during a function
held at New Delhi on 24th October, 2015. Dr. Guruprasad Mohapatra, IAS,

Sports as industry
BCCI is only one among hundreds other similar industries in every sport
besides culture, literature, disability, women, justice, secularism
and other subjects. They get "Grants in aid", foreign funding,
CSR contributions, donations and one time grants from central and state
governments, Public Sector Undertakings and Banks, private industries,
membership fees, contributory dinner for awards winners from awardees
(every recipient thinks s/he is going to get the award and actually
box full of awards and certificates are distributed to whosoever has
paid) and other publicly/officially unknown sources. TV channels organize
programmes for which CMs/Dy CMs open the treasury as the event is held
in 5* hotels and graced(!) by film personalities. High tea and dinner
costs something and the bill goes to the concerned government. Even
political donations in crores pour in easily and the donor is not known.
The skills of the game are not accessible to the public. Jo khel sakte
hein khelte hein. Perhaps little scope for judicial intervention or
oversight as those drawing salary from the exchequer always look the
other way! Only regret is: it kills competition.

Handiwork of IP&T AFS People
The letter of Vikram Singh appearing under heading ITS have usurped
wireless service sounds mischievous. It looks like handiwork of Indian
P&T Accounts and Finance Service People. The IP&T AFS officers
think themselves as superior just because they recruited through civil
service exam. The department of personnel & training is heavily
tilted to officers from civil service recruitments. Fact is in the telecom
department engineers are required to man the technical service. Accounts
people can at best play role of ancillary service but they can not manage
the technical organisation. If telecom is being abolished and if no
cadre review of ITS can take place then DOPT must apply mind that there
is no need for IP&T AFS. If cadre review of IP&T AFS has been
done despite no justification of this service in the light of abolishing
telecom and ITS service then surely cadre review of ITS can also be
done on same grounds.

ITS officers performing well
Believe me.... ITS officers are performing very well, but they are unable
to represent it at the appropriate level. Just get the feedback from
Home ministry about todays security of telecom field. Due to negative
intentions of the finance cader, they are not getting sufficient resources,
like support staff and sufficient number of posts. This is having negative
impact on overall Telecom Enforcement and Monitoring. They are in dier
need of supporting staff. The actual reality is that in the field offices
they dont have any support staff sanctioned. Even in such situatiuon
they are performing excellent. It is unfortunate that finance cader
is putting it's energies in giving negative feedback about ITS cader.
Yes ...If it is assumed that a cader is performing only when it is giving
negative feedback about someone,, then god save the nation....

Missing records cannot be used as an excuse to deny information
The appellant stated that he joined the service in 1981 and is
on the verge if retirement. He claimed that he has not got even
a single promotion during his entire service period, though he
is eligible as per rulers. He sought certain documents claiming
that due to non-availability of the said documents, the appellant
could not get his senior grade and selection grade. The PIO stated
that information sought by the appellant is not available. The
CIC observed that unless proved that record was destroyed as per
the prescribed rules of destruction/ retention policy, it is deemed
that record continues to be held by public authority. The CIC
pointed out that by practice, 'missing file' cannot be read into
as exception in addition to exceptions prescribed by RTI Act as
it amounts to breach of Public Records Act, 1993 The CIC directed
the PIO, Mr. the Principal and the Asst. Registrar to show-cause
why maximum penalty should not be imposed upon them for not providing
the information to the appellant and why disciplinary action should
not be recommended against them. Further, the public authority
was directed to explain why compensation should not be paid to
the appellant for harassing him by not providing the requisite
information for a long time.
Comments
In many government offices, the quality of record keeping needs
a massive overhaul. As per Public Records Act, 1993 action can
be initiated for any loss of public records and is punishable
with imprisonment up to a term of five years or with fine or both.
