do Kapil's role and Sidhu will be Sidhu.... or maybe Mrs Sidhu would

Sharad Kumar re-appointed as DG, NIA
Sharad Kumar has been re-appointed as Director General, National Investigation
Agency (NIA) for a period of another one year with effect from November
1, 2016. He is a 1979 batch retired IPS officer of Haryana cadre.

20 IIMs without directors
At present 20 Indian Institutes of Management are functioning without
Directors. No one knows the reason.
Who will be Meghalaya's DGP ?
Meghalaya In - Charge DGP S.K. Jain is superannuating on Oct 31. Race
is on to grab the top post of the state. He is a 1984 batch IPS officer.
It is said that IPS officers of 1985 batch are front runner for the
job. Announcement of new DGP is likely to be made next week.
Tenure of Rajneesh as PS to President of India
extended
The tenure of Rajneesh as Private Secretary to President of India, Pranab
Mukherjee, has been extended upto January 30, 2017. He is a 1997 batch
IAS officer of Himachal Pradesh cadre.

Mrs G Lata Krishna Rao has been relieved to join as Secretary, Department
of Social Justice and Empowerment in Government of India. Mrs Rao, who
belongs to a 1982 batch IAS officer of Karnataka cadre, will assume
the charge on November 1, 2016.

The Public Enterprises Selection Board (PESB), which has withheld advertisements
since September 1, due to some technical reasons, is expected to advertise
the vacancies in November.

Four IAS officers have been transferred and posted to different places
in Madhya Pradesh. Accordingly, Pannalal Solanki has been appointed
as Additional Secretary, Secretariat while Shekhar Verma was posted

to NR
Upon premature repatriation from deputation to IRCON, Amar Singh Chaudhary

places in Telangana. Accordingly, Manoranjan Bhanja has been transferred
as Additional PCCF Wildlife while M Prudhvi Raju was transferred as
Additional PCCF Production and Ms R Sobha is Additional PCCF, FCA).
Similarly Munindra as Additional PCCF, Admn& IT); Rakesh Mohan Dobriyal
as Additional PCCF, Social Forestry; Lokesh Jayaswal as Additional PCCF(CAMPA);
Sunil Kumar Gupta as Additional PCCF, Dev& WP) and Swargam Srinivas
was posted as additional PCCF, Protection & Vigilance.

IPTAFS cadre is recruited to manage the revenues
The IPTAFS cadre is recruited to manage the revenues from all customers
of DoT which is assigned to BSNL in 2000. To realise the licence fee
from 300 odd licencees, wisdom of Govt to allow strength of 400 strong
cadre is questionable. BSNL is in this position due to ITS and without
ITS it should have been like ITI, HTL etc. ITS is telecom service including
licencing and monitoring and no where it is written that ITS is for
landline. Ministry of Finance has given umpteen instructions that IFD
(internal finance Division) officers should not be given executive powers.

DOP&T's decision (TOI, Oct 20 ) revoking suspension of a Joint Secy
( IAS, AP- 93 ) in MHA , placing him under "compulsory wait",
is discriminatory, unjust, unfair and legally untenable. Two Deputy
Secretaries and one Section officer are still under suspension. Their
fault : Juniors belonging to " inferior services ". The favouritism
shown to top officer of elite Service, weakens the Prosecution's case
in the court. All officers should be treated at par for offences impinging
on national security under doctrine of "collective responsibility
"
Interceding in favour of the accused under pressure from 15 Joint Secretaries
of MHA, is bad in law. The group used hyperboles like "suspension
was demoralizing" and "harsh on the honest IAS officer"
besides standing surity for officer's "integrity and hard work".
Was this justified when investigations were and are reportedly still
underway.
Who authorized the group of 15 joint secretaries to issue a clean chit
to the accused? Gross interference in administration of justice? A clear
misconduct. No wonder, if, Joint Secretary's name is deleted from list
of the accused. Is the group of 15 not liable for prosecution under
IPC and the Conduct Rules for influencing the inquiry? Can one expect
just and fair investigation? Due diligence was not carried out by the
FCRA division headed by the re-instated Joint Secy before renewing licence
of the NGO ( IRF-Islamic Research Foundation ) headed by someone masquerading
as a preacher. No transparency, no accountability. The Government will
have lot to explain to Parliament in the coming winter session.

Missing records cannot be used as an excuse to deny information
The appellant stated that he joined the service in 1981 and is
on the verge if retirement. He claimed that he has not got even
a single promotion during his entire service period, though he
is eligible as per rulers. He sought certain documents claiming
that due to non-availability of the said documents, the appellant
could not get his senior grade and selection grade. The PIO stated
that information sought by the appellant is not available. The
CIC observed that unless proved that record was destroyed as per
the prescribed rules of destruction/ retention policy, it is deemed
that record continues to be held by public authority. The CIC
pointed out that by practice, 'missing file' cannot be read into
as exception in addition to exceptions prescribed by RTI Act as
it amounts to breach of Public Records Act, 1993 The CIC directed
the PIO, Mr. the Principal and the Asst. Registrar to show-cause
why maximum penalty should not be imposed upon them for not providing
the information to the appellant and why disciplinary action should
not be recommended against them. Further, the public authority
was directed to explain why compensation should not be paid to
the appellant for harassing him by not providing the requisite
information for a long time.
Comments
In many government offices, the quality of record keeping needs
a massive overhaul. As per Public Records Act, 1993 action can
be initiated for any loss of public records and is punishable
with imprisonment up to a term of five years or with fine or both.
