TATA ma Tata chaalse...
I'm back at the quaint eatery near Dalal Street with my Broker friend ..... today we are tucking into Pizzas Jasuben style (very famous in Ahmedabad) and very sweet tea.

Friend: Nakki hai... TATA ma Tata chaalse!!

Me: Is that the reason for Cyrus's sacking!!

F: Who knows ....I'm just guessing ...but this is for sure Cyrus and the Board did not get along !! Seems he was too fixated on the Finances and wanted to do 'extensive' Financial surgery....Steel ... Hospitality and Passenger Car investments ...

M: So now in his way Cyrus is hitting back ...by making his Email to Tatas Public ....Rattan has termed his doing so as very wrong ..

F: But he will fight back ...at such an age to be sacked from such a job... but I think it'll be shortlived !!

M: Yup I too feel the Parsi Community will step in .... Tata Brand is too precious for them...and really Tatas do a lot for the Parsi Community ....Rattan may have been the Chairman of Tata ...but personally his wealth is not like other Industrialists....he is not even on the Billionaire list .... Tatas are different... so will a Tata be the next Chairman...I hope so!!

F: Looks like .... you want to bet... I'll patch you with someone who accepts Bets ...a Muslim colleague was just telling me that she's really impressed with Modi!!

M: It's the triple Talaak issue he's taken up .....

F: If you ask me he's just netted for BJP a sizeable Vote of the Muslim Community ...because this triple Talaak is despised by many Muslim Women...

M: Unless now Muslim Men say it's their right to accompany their wives into the Polling Booth or they order their wives to abstain from voting....this shift will show up in UP.... I'm sure SP ..BSP ..Congress would be working on how to counter this ...

F: I hear Rahul wants to ally with Akhilesh in UP...

M: Just shows his naivety ... I tell you Congis must be really fearing ...aaj kya bolle ga Rahul Baba !!

F: There is this elderly Broker and he says. ... money and foolishness no one can hide ...bury money deep down in the earth but it'll show up on the face of the person whose wealth it is ...and try to make a foolish guy look intelligent ...buss mooh kholle ga and truth will come out!!

M: Kejriwal says he will prostrate himself in front of Centre for the sake of Punjab..

F: Gaando che ( Gujarati for mad) ...arre is the present Government saying that Centre has let Punjab down!!! Arre why doesn't he do this in front of LG ...after all he keeps lamenting that LG is stopping AAP from performing in Delhi a d delivering on its promises !!

M: Now it's being said his Wife will be the CM if AAP wins in Punjab ...Sidhu they say is being offered Deputy CM.....negotiations are on.....his 'I want 2 Tickets for my family' demand stands I hear ....

F: Ha ha ... Comedy Show in Punjab all 7 days ....Sunita Kejriwal will do Kapil's role and Sidhu will be Sidhu.... or maybe Mrs Sidhu would enact Sidhu's role ....she's the real Politician in the Sidhu household ...

M: Yes when Public goes to him for the pathetic performance of the Government he will say... Hazoor Punjab mein khille hai Gulaab... Gulaab ka luttf lo Gulaab nahi deththe koyi hisaab kitaab!!

Guffawing like Sidhu we go our ways ..

IPTAFS cadre is recruited to manage the revenues
The IPTAFS cadre is recruited to manage the revenues from all customers of DoT which is assigned to BSNL in 2000. To realise the licence fee from 300 odd licencees, wisdom of Govt to allow strength of 400 strong cadre is questionable. BSNL is in this position due to ITS and without ITS it should have been like ITI, HTL etc. ITS is telecom service including licencing and monitoring and no where it is written that ITS is for landline. Ministry of Finance has given umpteen instructions that IFD (internal finance Division) officers should not be given executive powers.

" Uniform treatment to all Services is hallmark of Good governance"

DOP&T's decision (TOI, Oct 20 ) revoking suspension of a Joint Secy ( IAS, AP- 93 ) in MHA , placing him under "compulsory wait", is discriminatory, unjust, unfair and legally untenable. Two Deputy Secretaries and one Section officer are still under suspension. Their fault : Juniors belonging to " inferior services ". The favouritism shown to top officer of elite Service, weakens the Prosecution's case in the court. All officers should be treated at par for offences impinging on national security under doctrine of "collective responsibility "
Interceding in favour of the accused under pressure from 15 Joint Secretaries of MHA, is bad in law. The group used hyperboles like "suspension was demoralizing" and "harsh on the honest IAS officer" besides standing surity for officer's "integrity and hard work". Was this justified when investigations were and are reportedly still underway.
Who authorized the group of 15 joint secretaries to issue a clean chit to the accused? Gross interference in administration of justice? A clear misconduct. No wonder, if, Joint Secretary's name is deleted from list of the accused. Is the group of 15 not liable for prosecution under IPC and the Conduct Rules for influencing the inquiry? Can one expect just and fair investigation? Due diligence was not carried out by the FCRA division headed by the re-instated Joint Secy before renewing licence of the NGO ( IRF-Islamic Research Foundation ) headed by someone masquerading as a preacher. No transparency, no accountability. The Government will have lot to explain to Parliament in the coming winter session.

DATE WITH RTI

Missing records cannot be used as an excuse to deny information

The appellant stated that he joined the service in 1981 and is on the verge if retirement. He claimed that he has not got even a single promotion during his entire service period, though he is eligible as per rulers. He sought certain documents claiming that due to non-availability of the said documents, the appellant could not get his senior grade and selection grade. The PIO stated that information sought by the appellant is not available. The CIC observed that unless proved that record was destroyed as per the prescribed rules of destruction/ retention policy, it is deemed that record continues to be held by public authority. The CIC pointed out that by practice, 'missing file' cannot be read into as exception in addition to exceptions prescribed by RTI Act as it amounts to breach of Public Records Act, 1993 The CIC directed the PIO, Mr. the Principal and the Asst. Registrar to show-cause why maximum penalty should not be imposed upon them for not providing the information to the appellant and why disciplinary action should not be recommended against them. Further, the public authority was directed to explain why compensation should not be paid to the appellant for harassing him by not providing the requisite information for a long time.

Comments

In many government offices, the quality of record keeping needs a massive overhaul. As per Public Records Act, 1993 action can be initiated for any loss of public records and is punishable with imprisonment up to a term of five years or with fine or both.
