Will history be repeated in CJI appointment?
There is a murmur in the corridors of power that the Modi Government
may follow late Indira Gandhi in the top Judicial appointment in the
country in January when present CJI T S Thakur retires. When late Indira
Gandhi was the Prime Minister Justice A N Ray had been appointed Chief
Justice of India superseding Justice H R Khanna a highly respected jurist.
Now again, there is a theory that the executive has the right to recruit
Judges.
Will Tushar Mehta be new Solicitor General?
Name of Tushar Mehta has started doing the round for the post of Solicitor
General of India. He is presently Additional Solicitor General.
Three IPS officers of 1984 batch to be empanelled?
A couple of 1984 batch IPS officers are likely to be empanelled as ADG
in the Government of India next month.

CPOs staff & Vehicles are at MHA's service?
If sources are to be believed large number of vehicles and staff are
deployed in MHA. According to sources more than 450 personnel mostly
constables have been put on duty with many officers. About 50+ vehicles
are also attached with various stages. These personnel and vehicles
belong to different CPOs. Because of this field units of these forces
are facing shortage of man power and staff.
Jayant Kumar deputed as GM(Projects), RVNL, Lucknow
Jayant Kumar Chaudhary has been deputed as General Manager (Projects),
Rail Vikas Nigam Ltd(RVNL), Lucknow for a period of five years. He is
an IRSE officer.
Minor reshuffle of IPS officers in UP
Vijay Prakash has been appointed as IG, Public Grievances while Ramit
Sharma was made IG, Technical Services and P K Mishra is IG, Headquarter
Allahabad. Besides, Dr Sanjeev Gupta has been appointed as IG, building
welfare in Uttar Pradesh.

cadre transfer. Patil, who belongs to a 2012 batch IPS officer, is posted

SAIL observes vigilance awareness week (UPDATED)
Observance of Vigilance Awareness Week commenced today at Steel Authority
SAIL with the administering of pledge by Chairman, SAIL, P K Singh.
The Chairman along with Directors of the company and other officers
paid floral tribute to the portrait of Sardar Vallabh Bhai Patel. Messages
received on the occasion from various dignitaries were read out by the
Directors of SAIL. During the week-long celebration many activities

Facilities to IPS officers
It is absolutely preposterous that the taxpayer should be burdened with
providing cooks and drivers and servants to retired IPS officers. Do
even the most senior military or civil officers or judges receive such
facilities after retirement? It's a sheer abuse of power. Even politicians
give up security after losing elections. Why should so called IPS officers
be any different? If spoiled and flabby IPS officers do not wish to
join CPO's because they won't be given government personnel as servants
for the rest of their lives, they are most welcome not to. All CPO's
have dedicated and fully competent officers of their own cadre who are
completely up to the task. Look at the Coast Guard. It has a DG from
its own cadre, and not borrowed from elsewhere. Why are IPS officers
needed in ITBP, or BSF, or any other CPO?

Whispers under influence of IPS lobby
Whispers are under the influence of the IPS lobby. What is the need
for the IPS to head the CPOs and why should every retired DG like SPS
Rathore and PS Natarajan be a sarkari damaad for all his life. In fact
I wonder how many of them face security threats. Each state has about
a dozen DGs.

MHA's step in right direction
MHA order on provision of staff and vehicles to retired officers is
a step in right direction. Present and retired officials of working
with MHA should also need to be brought under this provision as a large
number of officials and vehicles are deployed at home and their establishments
throughout the country. This will save lot of CPO personnel who are
working in inhuman conditions and will allow them to live with dignity
and save the govt. with lot of funds.

Indians always look for free lunches
We Indians are always looking for free lunches. The ladoos distributed
to every commuter at DND toll Plaza by those demanding DND flyway to
be made toll free and winning that battle in the Allahabad High Court
proved this trait. Little do these champions of free ride realise that
they will save Rs. 56 (Rs. 28 each way) at what cost. Experts have already
forecast traffic chaos on the Flyway as also on way to South Delhi.
Being a daily commuter myself from Noida to Delhi we had so far no serious
problem of traffic on the DND. Having a gold card with sensor on the
car you deposit lump sum amount of Rs. 3000 and just pass through the
specific lane without any hassle. Your daily balance is shown as soon
as you pass through. The traffic is bound to increase as those taking
other roads to avoid toll will get on this Flyway. Also who will maintain
the road when the concerned company is no longer allowed to charge.
Will PWD do it? Are they capable of that? Will it be outsourced? Who
bears the expenditure? The Government? A portion of bridge is in Delhi
and the rest in Noida. How they will share the expense? What will happen
to the staff (Quite a large number) employed by the company at the toll
plaza?Nobody seems to, not even the high court, looked into these questions
before giving the judgment on PIL. It is more of a populist verdict.

Missing records cannot be used as an excuse to deny information
The appellant stated that he joined the service in 1981 and is
on the verge if retirement. He claimed that he has not got even
a single promotion during his entire service period, though he
is eligible as per rulers. He sought certain documents claiming
that due to non-availability of the said documents, the appellant
could not get his senior grade and selection grade. The PIO stated
that information sought by the appellant is not available. The
CIC observed that unless proved that record was destroyed as per
the prescribed rules of destruction/ retention policy, it is deemed
that record continues to be held by public authority. The CIC
pointed out that by practice, 'missing file' cannot be read into
as exception in addition to exceptions prescribed by RTI Act as
it amounts to breach of Public Records Act, 1993 The CIC directed
the PIO, Mr. the Principal and the Asst. Registrar to show-cause
why maximum penalty should not be imposed upon them for not providing
the information to the appellant and why disciplinary action should
not be recommended against them. Further, the public authority
was directed to explain why compensation should not be paid to
the appellant for harassing him by not providing the requisite
information for a long time.
Comments
In many government offices, the quality of record keeping needs
a massive overhaul. As per Public Records Act, 1993 action can
be initiated for any loss of public records and is punishable
with imprisonment up to a term of five years or with fine or both.
