My reply
The response to my plea was as anticipated. They could not have
been otherwise. The question is not whether ICS officers and IAS officers
of my vintage were corrupt or not. Yes there were some. And that cannot
be eliminated. Nobody as usual seems to have read carefully what I have
suggested.
The process of selection and NOT THE SELECTION should be determined
by a committee consisting of two/ three noble laureates who know Indian
economy and its administrative structure well. The HM is the person
who is an important member of the ACC. The presence of the FM is necessary
as he manages the economic foundation of the country. The External Affairs
Minister is there to give inputs regarding selection for the IFS. The
eminent social scientist of India will give his / her inputs as to what
kind officers have to be there in the service given the complex nature
of our politico social structure. Cabinet Secretary being the primus
inter pares of all the services has to give his inputs to the committee.
The committee will determine only what kind of examination, age profile,
interview process and training are necessary and not to select candidates
as one commentator has said.
Now regarding the numbers arrested or are being prosecuted -it is absurd
to think that it is a small number and therefore everything is fine.A
district collector is the guardian of the welfare of hundreds of thousands
of people if not millions in some cases.If he is caught pants down or
arrested for corruption where will the distressed people go.We do not
have elected district officials.
Yes the service is the superior most but not elitist. The Collectors
do not do ball room dancing anymore as their ICS predecessors did but
unfortunately their dance is now to the tune of politicians. Should
this dancing to the tune of politicians continue in administration ?
This is what has to change. They must respond to the people's interest,
enforce laws fearlessly and offer their comments without fear or favour.
Some still do and they require to be commended.
Unless the two services IAS and IFS are separated and their recruitment
process is changed and their service conditions modified to ensure performance
we will witness a withering away of the service as it has started happening
in TN with a former Chief Secretary after first being demoted stands
suspended as of yesterday.
It is for the new generation to take a call.

Regulations on adulteration a farcry
Central govt is making a lot of noise about preventing adulteration
in edibles and other consumer goods but the administration of the regulations
in this behalf continue to be a far cry. A very simple and effective
solution of the issue could be requiring the manufacturer to indicate
on the packing of the article itself the method of checking the purity
of its contents by the consumer himself. Spurious and adulterated products
would lose the market in no time while the pure and genuine ones will
earn public goodwil and confidence. Let Swami Ramdev take the voluntarily
in respect of Patanjali products. Other players will be forced to follow
in no time.

Were medals at Rio rigged before hand ?
While India did badly at the Olympics, the BBC had already started drumming
up a campaign against India a week before. This could mean that the
award of medals at the Games could have been rigged before hand. After
all this happens all the time in cricket matches all over the world.
There is nothing sacro sanct about the Olymic Games and they are not
free from big betting money and politics by the former super powers,
the USA and the USSR. See the enormous amount of politics involved in
the anti-doping verdict which was aimed specifically against President
Putin. How come only the anglo-saxon powers who are close allies alone
got all the gold medals ? The leftovers were distributed here and there.

Perennial difficulty of govt servants
The problem of pending bill either of TA/DA/ Medical or any other type
is a perennial difficulty faced by government servants. You have highlighted
the problem and also a possible solution. In this case, the person got
the bill sanctioned using the power of RTI. But the administrative staff
can try to take revenge by delaying all the future bills.

Delay in clearance of Medical bills
A pensioner had submitted medical bills for reimbursement, which
were kept pending by the respondent authority, for a long time.
Hence, he sought information on the status of the same through
the RTI application. The appellant submitted that he is the life
member/beneficiary of the DGHS (Delhi Government Health Scheme)
and as per the circular issued by them on 1.4.1997, he is entitled
for 100% reimbursement of his medical bills. But the respondent
authority has not taken cognizance of the same and he was made
to wait for receiving the reimbursement for a long time. The respondent
authority submitted that all his medical bills were settled and
he has been paid all the medical dues in February, 2015. They
also explained that the delay is due to the fact that the case
of the appellant is the first of its kind, as he has retired from
an aided school and as per the rules, the aided is required to
bear 5% of the reimbursement and rest of the 95% will be borne
by the Department of Education. But this rule is applicable only
for serving employees of the aided schools. In this case, the
appellant had retired and the bills are submitted after his retirement.
Even the circular issued by the DGHS, which is being referred
by the appellant, is not clear in the case of pensioners who had
retired from aided schools. The CIC noted that the appellant is
76 year old senior citizen. The CIC directed the Rakesh Khadgam
Senior Accounts Officer (deemed PIO) to show cause why maximum
penalty should not be imposed on him for the delay in furnishing
the information to the appellant.
Comments
This case depicts that the RTI Act, 2005 has not only emerged
as a tool for obtaining information, but also for enforcing the
rights.
