Why proposal for BSF cadre review is getting delayed ?

A cadre review proposal is to be prepared and put up for the cabinet approval. But the problem is MHA is seems to be not in hurry to to put up a cabinet note regarding BSF cadre review. Last cadre review took place in 1991.

Outstanding works of Mrs Kacker as Chairperson, NCPCR

Mrs Stuti Kacker, who has been functioning as Chairperson of the National Commission for Protection of Child Rights (NCPCR) since September 15, 2015, has proved her mettle with outstanding works. The Commission was without Chairperson since October 2016 and therefore, series of administrative measures were taken to streamline its functioning resulting in the following special achievements in one year. The Commission monitors all laws, policies, programmes and administrative mechanisms in the country to ensure children's rights as enshrined in the Constitution of India are protected. Disposal of more than 1600 complaints (pending since long); took suo-moto cognizance of about 100 cases along-with several spot inquires. POCSO E-box created for direct online complaint by children against child sexual abuse; awareness against sexual abuse created through messages aired on AIR and display of posters on Delhi Metro. For the first time 2 large scale melas i.e. Simhasth Kumbh Mela at Ujjain and Krishna Pushkaran Mela at Andhra Pradesh were declared child friendly melas in coordination with the concerned State Governments. Organized 26 National/State level consultations, workshops for creating awareness on various child rights. Developed Standard Operative Procedures (SOPs) for Rehabilitation and Restoration of Children in Conflict with Law; and for Street Children; User Handbook for implementation of POCSO Act, 2012; Safety Guidelines for the Protection of Children undergoing sports training; monitoring of all the parameters of SOP with Railways at 20 Railway Stations for children in contact with Railways resulting in rescue of 7209 children of which 3620 were restored to their parents. Developed and forwarded recommendations on New Education Policy to MHRD based on the outcome of Regional Consultations, Bal Samvad and National Consultation; developed guidelines for: safety and security of children in schools; recommendations on re-engagement of out of school children. Advisories issued to State Governments regarding prevention of child marriage, bore-well death etc. for protection and safety of children. Awareness generated through Radio spots on substance abuse and use and sale of tobacco products by children under JJ Act, 2015, along-with advisories to all tobacco companies and State Governments.

Another ill thought measure

Government has brought in another ill thought measure to delay and subvert the empanelment procedure.360degree feedback-a process by which the feedback on employee's performance is obtained from his subordinates, peers, supervisors as also from the members of public he/she comes into contact in the discharge of his duties. A process which German military first utilized in World War 11 in order to evaluate performance during War has been embraced by our Government without realizing that the same is not valid, reliable or even practicable in the Indian and sarkari contest. We Indians are always influenced by subjective impressions and are known to carry grudges, jealousy and petty thoughts about peers, bosses or subordinates. How their feedback is going to be reliable in the evaluation of an officer. Such multi-rating process will result only in delays. When we cannot think of any good and meaningful administrative reform, we pick up one jargon from elsewhere and adopt it without thinking whether it fits the bill here or not.

Time to ponder over judicial appointments


Genuine or healthy criticism of issues effecting public at large has always been welcomed by the institutions established for alleviation of the sufferings of masses - be the denunciation relate to the issue of an ordinance by State taking over land from farmers for and in the name of so called public cause , disbursement of huge loans (largesse) to entrepreneurs by banks or opaque auctioning of spectrum by Government . Had it not been so the corrupt and ulterior motives of Huda government of wrongfully depriving the farmers of their land, the criminal conspiracy hatched or devised by public servants to extend wrongful gain worth billions of rupees to Vijay Malaya and business friends of former Minister A Raja by cheating the exchequer , to quote a few of the cases would have remained buried in the books of frauds. It was solely due to the public out cry that these scams and scamsters could be brought to justice. But more importantly the public figures manning these institutions accepted the public censure as an opportunity for plucking the loopholes in the system rather than rubbishing the accusations with arrogance. We all debated and then as a result successfully formulated new fool proof policies to ensure that recurrence of such offences entailing public loot remains at bay. Entire relook culminated in a manner that strengthened our economy , democracy ; the judiciary playing a significant role in this stupendous task. Political parties including former Prime Minister acknowledged the rot and distanced themselves from the accused (mighty)for the law to take its own course. That is the kind of magnanimity of the conduct that the people occupying seats of dispensation are expected of.
Unfortunately developments within the judiciary with regard to appointment of judges are in complete contrast to the oath - shall speak the truth and truth alone - regularly administered and recited in the temples of hope and justice. The three organs of democracy defined in the Constitution -Legislature, Judiciary , Executive - are equally demarcated with thick partitioning walls as to the roles and powers of each organ . Undeniably Parliament is the supreme. Yet subsequent to the Apex Court assuming powers at its own of appointing judges in the High Courts and Supreme Court through the Collegium the system, has always been mired in controversies the main being of favouritism viz-a-viz opaque. The former Secretary General Lok Sabha , and eminent constitutional expert Dr. Subhash C Kayshap calling the judgement scrapping the NJAB as unconstitutional , three former CJIs endorsing the allegations of impenetrability , a senior sitting judge of the Apex Court and member of the Collegium publicly denouncing the process of selections of judges by distancing himself from the proceedings , and several prominent legal luminaries including Justice Sodhi of Delhi High Court calling it a mockery can not be wished away without basis/reasons definitely making a strong case for a relook of the whole selection mechanism to arrest the dwindling faith of public in the Courts. The argument that for the sake of freedom of judiciary the collegium is bestowed upon lacks merits and defies the very principles of natural justice that the Apex Court repeatedly reiterates through its landmark judgments . Let the path to the principles of merits and transparency laid down by Apex Court be first opened for public scrutiny equally for its own premises. No one can influence a judge of High Court or Supreme Court , irrespective of the mode of appointment , be it by executive or judiciary provided it is fair, transparent and meritorious as the judge once appointed is beyond the scope of political interference unless he himself eyes a governorship post retirement. Let the introspection and soul searching begin at the earliest.

It is also requested to take proper posting officer in their expertise of the subject/knowledge so that face of the organization and IR will be benefited like other Pvt company uses the right person on the right place so that the process from the raw material to the final end product and quality control is being controlled with economical way which is most important to compete open market. Particulars of the Appellate Authority

The appellant had filed a complaint with the public authority and sought information about the action taken regarding the same. He later filed a complaint with the CIC alleging that PIO did not provide the particulars of the First Appellate Authority in his reply. He also insisted on compensation for non provision of information and harassment. The CIC awarded compensation of Rs. 2500/- to the Appellant. The CIC also directed the PIO that in future, the details of the FAA and the period within which appeal can be made should be intimated.

Comments

All PIO’s and FAA’s should take a careful note to the provisions of the RTI Act and ensure that while replying to RTI application the name and other particulars of the next level of appellate authority and the period within which appeal can be made should be invariably mentioned.
