Kerala assembly elections are heading towards an interesting stage. According to Observers though BJP has little presence in Kerala but its alliance with SNDP could benefit the party increasing its vote percentage. SNDP has deep roots among Backwards which has sizable voters in the state. If they vote for BJP it is bound to eat LDF vote share . In such a scenario Congress lead UDF may get simple majority.

"Modi has no parallel"
-Prime Minister Narendra Modi who till a little less than two years ago was beloved of the majority might be losing charm in the opinion of some people but the question is that does any one else including his opponents - Rahul, Mulayam or Lalu - have any charm ?
This question came up in the wake of response of the surfers of whispersinthecorridors.com who were asked - "Is PM Narendra Modi losing his charm ? Is he a changed man ?" While some replied in the affirmative, majority did not agree and some of them even asked who else among Indian politicians can stand parallel to him and suggested 'to see the things in the right perspective'.

" Administrative tribunals are here to stay ".

Apropos the post "Time to abolish Administrative Tribunals " (WIC March 21,2016 ).
Suggestions for either abolishing tribunals or re-designating Supreme court as the Appellate Authority, are not implementable. Consider the following factors for a reality check.

(i)The tribunals are made up of serving or retired judges and officers drawn from judicial and administrative streams . Induction of retired officers without hands- on judicial experience, has reduced the tribunals ( at Centre and States ) as parking lots for the ruling political Executive to reward their favourite officers for pliability;

(ii) Retired bureaucrites manage to get appointed as government counsels, extracting huge fees from the tax payers funds. Thanks to rampant corruption in Law ministry.

(iii)Divesting the high courts of Appellate jurisdiction ( against CATs' judgements) was declared un-constitutional by the Supreme Court's verdict in Chandra Kumar case (1997). The aggrieved cannot approach the Apex Court directly against an order of the CAT, without first going to the concerned high court.

(iv) Reverting to suggestion for abolition, since the tribunals are creatures of the Constitution, their abolition will require approval of Parliament. This will be mired in political controversy in the present scenario.

(v) The proposals for abolition of tribunals are bound to invite the ire of major trade unions;

(vi) CATs' Bar associations will never take the abolition, lying down. There will be All-India agitations against the move, for losing business. Rozi Roti kaa sawaal hai.

(vii)And, worse, why would the Civil Services associations lag behind ? Will they not lose their post-retirement bonanza ?

Learn to live with the tribunals despite large pendency causing huge drain on public exchequer.

How to reduce pendencies ?

(a)Focus on providing Good Governance for grievance redressal to reduce pendency of cases.

(b) GOI as the largest litigant, must exercise restraints in filing appeals in High courts, in service matters. Settlements with employees outside courts must be encouraged.

(c) Strengthen infrastructure; Use information technology.

Fraudulent surrender of LIC Policy

The Appellant took a health plus policy. She learnt that her policy was surrendered without her knowledge on the basis of her forged signatures on the policy and the amount was used for taking two new policies by her mother-in-law. She complained to LIC and got an FIR registered at Meerut. The LIC informed her that they had sought the explanation of the agent concerned. She asked for a copy of this explanation of the LIC agent under RTI which was denied to her. She argued that the information sought related to her and therefore, she was not a third party and had a right to get a copy of the explanation. LIC stated that on the basis of a complaint, they had paid the amount along with interest to the appellant and redressed her grievance. The copy of the explanation submitted by the agent was denied claiming it to be personal information related to the agency. Relying on the Apex Court judgment in Girish Ramchandra Deshpande case, the CIC upheld the denial of information

Comments

The appellant was able to get back the amount with interest due to the pressure created by RTI application. It is a mute question whether an explanation of the LIC agent in respect of alleged fraud committed in respect of a client can be called as a third party information.
