-Prime Minister Narendra Modi who till a little less than two years
ago was beloved of the majority might be losing charm in the opinion
of some people but the question is that does any one else including
his opponents - Rahul, Mulayam or Lalu - have any charm ?

Checking terrorism exported to India from Pakistan imperative
The Jehadi attacks in Europe is because of American imperialism in the
Middle East and racial discrimination against Arabs and Asians on a
daily basis in every walk of life in Europe. Indian tourists to the
West will confirm that. In a way they are getting what they asked for.
Trump , the future President of America wants Americans out of body
bags. He wants to stuff them with Europeans. This means that USA will
follow an isolationist foreign policy and leave Europe to face the Jehadis
alone. Europe is porous and the jehadis will have a field day. There
are in all about 50 million Muslims in the West, some 17 million in
America and some 30 million in Europe. Given the increasing Islamophobia
and unemployment among young Muslims in the West and racism against
coloured immigrants, the number of the radicalised Muslims will only
increase. They don't have to travel to the Middle East for training
any more. They can have it all in Europe. ISIS has already declared
Rome the future capital of the Islamic Caliphate. It will be in India's
interest not to take sides in this burgeoning conflict. The Modi government
has taken the right step in calling a World Sufi Conference and encouraging
moderation and tolerance. India should isolate the Wahabi brand of extreme
Sunni Islam in India in its own interest and work towards the break
up of Pakistan into 4 independent republics , all weak and all dependent
on Indian aid. This would be the best solution to the menace of terrorism
exported to India from Pakistan.

Justice Rafat Alam - a gentleman
Justice Rafat Alam will be leaving Central Administrative Tribunal,
Principal Bench. He will be remembered as a Gentleman Judge, soft hearted
person and honest to the core who brought transparency in working of
Tribunal. He has been regularly rotating the Benches and made best efforts
to ensure fellow Judges give quality Judgements. However he was too
lenient in several things. Now it is learnt Justice Permod Kohli, retired
Chief Justice of Sikkim High Court, will be taking over as Chairman
in the Central Administrative Tribunal. Litigants have great expectations
from him and it is hoped he will carry forward the good work started
by Justice Rafat Alam. The first daunting task before Justice Permod
Kohli is to end the nexus between Judges and Lawyers. Uncle Judge syndrome
must end among Judicial Members. Also he should bring to end cadre loyalty
syndrome amongst Administrative Judges. The quality of Judgements needs
to be improved and well researched. At present 85% cases decided by
CAT are being challenged before High Court. Therefore if Judgements
are sound appeals will be less and burden on High Courts can be reduced.
The Judges especially Administrative Members should be rotated at least
once in the middle of their fixed tenure. Also they should not be posted
in the Cadre State from where they retired or their home state. Such
steps will bring improve quality of judgement and destroy vested interests.

Justice Permod Kohli Retired Chief Justice of Sikkim High Court has
been appointed Chairman of CAT for a period of 5 years. Justice Permod
Kohli is an intelligent person and as Judge of The Punjab & Haryana
High Court, he has delivered so many judgments which have been land
mark. As Chairman of CAT he will be an asset with the Tribunal and will
be helpful to streamline the system.

Need to change grievance redressal mechanism of DoPT
The present system is creating harassment of corrupt top official, because
it was forwarded to corned department, and they give fraudulent reply
to save the skin, and closed the cases later they start harassing and
resulted they become victimized and they commit suicide, in this process
PMO do not know the reality and they are getting wrong feed backs, PMO
should get real feed back, without disclosing the identity

Copies of documents held after the completion of retention
period
The appellant filed the RTI application seeking attested copies
of external examination question papers of B. Arch. for a certain
period, some answer sheets etc. The Respondent informed that according
to rules of the University, the students are supposed to apply
for copies of answer sheets, within 15 days from the date of declaration
of the result. As per the University's retention policy, answer
sheets are retained for three months, from the date of declaration
of result. But, if the student fails to apply within the prescribed
period of 15 days, the answer sheets cannot be given to the student,
though the same are held by the public authority upto three months.
The CIC ruled that the above retention policy of the University
is not a correct practice. If they have retained the answer sheets,
even after the prescribed retention period for any reason, they
cannot deny if it is not destroyed as on the date of RTI application
Comments
No public authority can impose additional restrictions over and
above those prescribed under Section 8 of the RTI Act to deny
any information to the applicant. A Public Authority is expected
to make its own record retention policy and provide information
to any RTI applicant as per the same as long as the records are
not weeded out. If the records have been retained even after the
prescribed retention period, copies of the same cannot be denied
if it is not destroyed as on the date of RTI application. Further,
a Public Authority is required to hold the records, if an RTI
application is pending before the authorities.
