Overall net profit of all 235 CPSEs during 2014-15 stood at Rs 1,03,003 crore compared to Rs 1,28,295 crore during 2013-14 showing a decrease in overall profit of 19.71%.

-Prime Minister Narendra Modi who till a little less than two years ago was beloved of the majority might be losing charm in the opinion of some people but the question is that does any one else including his opponents - Rahul, Mulayam or Lalu - have any charm ?
This question came up in the wake of response of the surfers of whispersinthecorridors.com who were asked - "Is PM Narendra Modi losing his charm ? Is he a changed man ?" While some replied in the affirmative, majority did not agree and some of them even asked who else among Indian politicians can stand parallel to him and suggested 'to see the things in the right perspective'.

Why this dichotomy in approach to tackling corruption ?


For the political class, the insinuations lapse with the short-term memory loss of the public.
The civil servants, on the contrary, do not have the luxury of oral explanations to cover malfeasance, if any. They are suspended and show-caused immediately. Why this dichotomy in approach to tackling corruption in public service? The hypocrisy and double standards will not stand the scrutiny before the Court of law. The law makers are expected to take the initiatives to remove the anomaly in the context of the doctrine of "Right to Equality before the Law ".

It's an irony

It is an irony that all appeals against the judgment of CAT lie with the respective jurisdictional high courts. In customs and excise cases there is a provision to file civil appeals directly in the supreme court, against the decisions of CESTAT, which is another tribunal, a creation of the Customs Act 1962, and not directly of the Constitution. There is a provision for filing customs appeal in the high courts in certain cases after the decision of the CESTAT, but other cases go directly in appeal in the Supreme court. CAT is having a bigger status than that of CESTAT, there should be a likewise provision where appeals against CAT decisions are filed directly in the Supreme Court. That will enhance the ranking of the CAT. Anyhow, the composition of CESTAT and CAT is same, equal nos of technical and judicial members, but the administrative member of CAT is of Secretary to Government of India rank while that of CESTAT come from the Commissioner or Joint Secretary rank. It is also true that the decisions of the CAT are not upto the mark, the delay is long, and the litigants suffer. The National litigation policy of the present government may also be stillborn like that of the previous one, as nothing has come out even though the government is completing its second year in office. If the policy is delayed further, the ruling party may not be able to reap the benefits in time.

About empanelment of IAS officers of 1998 batch, it is good the Modiji is applying standards to officers from all services for selection as Joint Secretary and not empanelling those who may not be suitable for central government. Officers from no service should be too complacent about such selection.

DATE WITH RTI

Copies of documents held after the completion of retention period

The appellant filed the RTI application seeking attested copies of external examination question papers of B. Arch. for a certain period, some answer sheets etc. The Respondent informed that according to rules of the University, the students are supposed to apply for copies of answer sheets, within 15 days from the date of declaration of the result. As per the University's retention policy, answer sheets are retained for three months, from the date of declaration of result. But, if the student fails to apply within the prescribed period of 15 days, the answer sheets cannot be given to the student, though the same are held by the public authority upto three months. The CIC ruled that the above retention policy of the University is not a correct practice. If they have retained the answer sheets, even after the prescribed retention period for any reason, they cannot deny if it is not destroyed as on the date of RTI application

Comments

No public authority can impose additional restrictions over and above those prescribed under Section 8 of the RTI Act to deny any information to the applicant. A Public Authority is expected to make its own record retention policy and provide information to any RTI applicant as per the same as long as the records are not weeded out. If the records have been retained even after the prescribed retention period, copies of the same cannot be denied if it is not destroyed as on the date of RTI application. Further, a Public Authority is required to hold the records, if an RTI application is pending before the authorities.
