Chat with my respected friend ..

Chat with respected friend

One more day in Shimla and I meet my friend .... a retired very Senior Bureaucrat. ...at Cafe Sole. Over Soup of the Day and sandwiches we get chatting...

Me: So Court has okayed a floor test in Uttrakhand..

MF: Odd if you ask me ... the President had imposed Governer's Rule and via this order the Court has partially negated President's Rule....I'm sure Centre will contest this in Court..

M: But by the reactions of both Parties what's your take..

MF: See Centre, BJP, has to test the Judgement .... because otherwise it's a tacit acceptance that it's own judgement of the situation was wrong.....Congress is happy with the floor test but it knows if the 9 rebels vote it's goose is cooked ....

M: So Horse Trading must have resumed there ...

MF: With gusto.... I was just reading this johnny Prashant Kishore in UP will have a 400 cr campaign budget... and he's advised that in UP Priyanka play a bigger role than just in Gandhi Burroughs....

M: I read the article .... this is so damning for India... a Housewife is requisitioned for campaigning just because of her surname ...the message is we are a gullible lot who are fit to be ruled!!!

MF: And this also makes Rahul look .....unfit...maybe Kishore's next request will be that wherever Rahul campaigns...in 48 hours Priyanka should campaign there ...

M: In Assam Modi graciously halted his speech when he heard the Azaan.... now Congress terming it as a drama..

MF: If appeasement was his way he'd have accepted the Fez Cap offered to him by a Maulvi... the stopping for Azaan was just a gesture of respect and politically correct.....but these guys will spin anything he says or does...

M: Like he said during his Chaiwallah days he made tea with Assam Tea and he felt he was in debt to Assam..

MF: Actually this comment was for the Assam Tea Gardens ... which are being wooed by all Parties..and he did not lie ... because the tea that such vends serve does come from Assam....

M: Sonia in Assam has been mocking Modi by saying on one side Modi says he will bring back back Black Money and on the other hand let Mallya who took loans from Indian Banks slink away...

MF: First she needs to answer why during UPAs stints did Banks bend backwards to give Mallya loans ...many times against the norms ...like for advances ...for brand KF etc. ..

M: What's your psephology about Assam and WB...

MF: In Assam ... BJP.... in WB... TMC....

M: Sir what do you feel if General Elections are to be held today who would come out tops...

MF: Won't be a cake walk for BJP... there is so much poverty that the poor......who vote religiously ...always feel the 'other guy' will be the Deliverer....but it's still early days ...knowing Modi he has to have a gameplan ... first was Recovery Stage ....now Consolidation Stage is on ... let's see what would be the next stage ...my guess .... Populist ... see you next time when you come to Shimla....wait a minute.. Flash News message on my phone ...No Floor Test on 31st....case adjourned to April 6...
MF: Yeh toh honna tha....

Regarding implementation of the Report of the 7th CPC

This refers to the specific recommendation under Highlights No.12 of the 7th CPC regarding pay parity among central government employees (CSSS, CSS) Headquarters and employees working in Non-secretariat organizations i.e. field.

In this connection, the representatives of Central Government employees are raising a point regarding down grading of their Grade Pay to their counterparts working in field offices i.e. Non-secretariat organizations, which also covers the central autonomous bodies. Needless to mention that the recruitment rules/process, other service bye-laws and nature of duties of both categories of employees are the same.

It would have been better if they should have demanded for similar pay-scales for common categories as per recommendations of the 7th CPC. Needless to mention that 6th CPC also made same recommendation which was accepted by the Central Government but later changed which was totally against the spirit of recommendations of the 6th CPC duly approved by the Cabinet.

My submission is that since employees working in non-secretariat organizations which also includes employees of central autonomous bodies are not represented in Delhi, therefore, officers of the Finance Ministry and DoPT who are part of the Empowered Committee constituted by the Prime Minister of India may please address this issue and do the justice.

High Court bench in western UP

Power play of vested interests or a conspiracy alone would explain non creation of a bench of Allahabad High Court in western UP. MP High court has a bench in Jabalpur and Gwalior perhaps so does Bombay High Court in Nagpur. A long standing reasonable demand has not been fulfilled. The Supreme Court and the Govt. Of India are perhaps waiting for a violent agitation in western UP on the pattern of reservation Andolan by Jats in Haryana. They should instead listen to the reason and set up a bench of Allahabd High Court at a suitable place in western UP. Sooner the better.

DATE WITH RTI

Copies of documents held after the completion of retention period

The appellant filed the RTI application seeking attested copies of external examination question papers of B. Arch. for a certain period, some answer sheets etc. The Respondent informed that according to rules of the University, the students are supposed to apply for copies of answer sheets, within 15 days from the date of declaration of the result. As per the University's retention policy, answer sheets are retained for three months, from the date of declaration of result. But, if the student fails to apply within the prescribed period of 15 days, the answer sheets cannot be given to the student, though the same are held by the public authority upto three months. The CIC ruled that the above retention policy of the University is not a correct practice. If they have retained the answer sheets, even after the prescribed retention period for any reason, they cannot deny if it is not destroyed as on the date of RTI application

Comments

No public authority can impose additional restrictions over and above those prescribed under Section 8 of the RTI Act to deny any information to the applicant. A Public Authority is expected to make its own record retention policy and provide information to any RTI applicant as per the same as long as the records are not weeded out. If the records have been retained even after the prescribed retention period, copies of the same cannot be denied if it is not destroyed as on the date of RTI application. Further, a Public Authority is required to hold the records, if an RTI application is pending before the authorities.
