Present RBI Governor should be given another chance

Caste and community segregation at LBSNAA
It is upsetting to know that at LBSNAA Mussoorie also there is this
caste and community segregation as brought out by an IRS probationer.
The authorities should consider such discrimination as unworthy of an
institution which trains the elite civil servants of the country and
take action against those who indulge in this caste bias. This should
also be included in the Civil service Conduct rules that anyone who
shows such discrimination on the basis of caste would be suitably penalized.
Also it is high time our educational institutions are also freed from
this menace.

IRS probationer feels discriminated
IRS probationer feels discriminated in the academy-yes, this issue
has been begging an open minded debate since long! How will civil servants
deliver fair and just services to the citizenry if they themselves discriminate
or are discriminated in the rigid caste system of bureaucracy?

Abolish caste based selection
Apropos the letter "Public servants or public masters" from
an IRS probationer about discrimination faced by him being from the
reserved caste, the only solution for this is the abolition of caste
based selections. Not only their batchmates but even public in general
look down upon them as ones who got into the services undeservedly.
I know many who will not go to a doctor if he belongs to a reserved
community knowing well that he would not have got into the medical college
by direct competition. This looks more demeaning when certain rich communities
like Mopla Muslims of Kerala, Jats etc have got into reservation basket
by sheer vote bank politics. If almost 70 years after independence and
continued reservation have not brought up the communities the problem
lies elsewhere. It is time we do away with religeon and caste based
reservations in central services, professional colleges and even judiciary
so that a group of people are not brought up with a perpetual inferiority
complex.

Judicial backlog of pending cases calls for extra-ordinary solutions
The integrated judicial system in India is known for huge pendency.
Due to filing trumpery cases by habitual litigants, precious time of
courts is wasted, which otherwise, could have been utilised on crucial
matters concerning the poor. The adage -- Justice delayed is justice
denied is relevant to India .Delivery of timely judicial verdicts, is
an integral part of our Fundamental Right to Justice. The Indian society
has grown highly litigious -- flooding courts with non-serious petitions
and appeals for insignificant causes. Appeals are filed invariably for
frivolous reasons and in the hope of getting favourable judgments. The
appellate courts must curb these expectations and restore faith in courts
of original jurisdiction. Justice M C Chagla in his autobiography (Roses
in December)has dealt with this problem. A must read for judges and
lawyers. The PILs are filed not to benefit the poor. These are, in fact,
disguised to benefit the political heavy weights, the cash rich industrial
houses, builders mafia etc. The lawyers' motive is to pocket hefty fees,
for self- publicity through electronic media, scoring professional vendetta
and other extraneous considerations. How to reduce pendencies? The CJI
is justifiably concerned about the rising pendency of cases due to scarcity
of Judges. Extra-ordinary problems call for extra-ordinary solutions.
Number of cases pending in Indian courts is estimated to be over 3 crores.
Of these, 2.7 crores cases are reportedly pending in subordinate courts;
40 lakh cases in 24 High Courts; 52,000 cases in Supreme Court. Here
are some suggestions :-- (a)Focus on Good Governance for grievance redressal;
(b) GOI as the largest litigant, must exercise restraints in filing
appeals in High courts, in service matters. Settlements with employees
outside courts must be encouraged; (c) Strengthen infrastructure; Use
information technology;(d)Club cases of same nature by courts and treat
them at par; (e) Promotion of Gram-Nayayalay and proper regulation by
allowing greater powers ; (f) Conducting Lok Adalats more frequently
; (g).Fast track mechanism for justice seeker of sexually assaulted
victims, SC, ST and the Minorities; (h) Unfortunately, practising judicial
activism by junior judges .Make judges accountable to deliver time-bound
and well-reasoned judgements. Reasons for giving frequent adjournments
must be probed by committees and the defaulters reprimanded, wherever
considered necessary; (i) The judges these days are more concerned about
passing judgments banning IPL matches due to draughts, forcing ladies
to enter temples etc. The social issues should not be mixed up with
legal issues. The main job of the judiciary is to interpret law and
deliver judgements , rather than creating new laws. Let this job be
left to the Law makers.; (j) Appoint retired judicial officers as ad
hoc judges by invoking Art 224 (A) of the Constitution of India ; (
k) Delete cases and judgments from lists of pendencies that have become
in fructuous and time-barred; (l) Speed up bulk recruitment through
States Judicial Services. Collective and co-operative efforts by the
Judiciary and Executive to monitor progress of action taken, is the
need of the hour.

Failure to provide the information
The appellant sought information pertaining to travelling status
of a PNR number. No reply was given to him. The appellant stated
that he could not board the train because of rush When the case
came up before CIC, the respondent stated that the appellant had
not travelled. The CIC directed to public authority to provide
the information to the appellant through nodal CPIO of the Railway
Board. The CIC admonished the First Appellate Authority for dereliction
of duty and issued show cause notice to the PIOs why penalty should
not be imposed on them.
Comment
The RTI Act, 2005 prescribes a time limit for the PIO and the
FAA to respond to the applicant. Failure to reply to an applicant
within the time limit laid down under the Act may invite the displeasure
of the Information Commission.
