'RTI Act needs more stringency than dilution'
Draft RTI rules 2017 superseding 2012 Rules have been circulated by GOI to invite comments from civil society. Views of public-at-large in rural India have not been sought. Why restrict it to internet-friendly users? Why, no press notice for wider reach and invite views of all stake holders? An exercise in futility and Self- deception. A stratagem to distract people' attention from its growing demand for bringing Political parties, Judiciary and political Executive within the purview of the proposed RTI Act 2017. A highly regressive step, a ploy to discourage RTI applicants and make them vulnerable to Mafia, adversely impacted by RTI applications. Any RTI applicant could be forced by the mafia either by pecuniary allurements or physical threats, to withdraw or amend the original application under the proposed amendment. Attempt at total dilution of present rules to benefit big business houses, the bribe-givers, bribe-takers, blackmailers, black marketeers, mafias, builders etc. RTI Act 2005 is toothless. Its new avtaar will be gumless. Hypocrisy par excellence. The present political dispensation and its elite bureaucratic doormats are expected to be more honest in their endeavour for transparency?
If, it is not possible to enhance the scope of present RTI Act 2005 and Rules 2012, why not give the Act, a quiet burial ?India, perhaps, does not deserve it. Ethical Governance is irrelevant. Let corruption continue with vengeance.

DATE WITH RTI

Grievance redressal is beyond the purview of RTI Act

The Complainant submitted that vide his RTI application, he had sought details of the action taken on his earlier representations regarding granting him temporary status, etc. It was also submitted that he had sought the attendance details of other daily wage earners which was not provided to him. In reply, the Respondent (Delhi) submitted that information regarding attendance of Casual Labours was related to Field Department, Meerut and hence the application was transferred to Meerut vide letter of April, 2013. The Respondent (Meerut) submitted that all available information was provided to the Appellant. The Complainant submitted that in essence his RTI application related to the grievance of granting him a temporary status as opposed to other junior employees. The Commission observed that under the provisions of the RTI Act, 2005, only such information as is available and existing and held by the public authority or is under control of the public authority can be provided. The PIO is not supposed to create information that is not a part of the record. He is also not required to interpret information or furnish replies to hypothetical questions. Similarly, redressal of grievance, reasons for non-compliance of rules/contesting the actions of the respondent public authority are outside the purview of the Act.

It is often seen that the CIC is approached for redressal of his grievance. Everyone must realise that RTI is the forum for obtaining information and that armed with the necessary Page information, an individual may approach the appropriate authority for further necessary action.
