Vested interests raising falsehood

Various vested interests are raising the falsehood that demonetisation is a failure, because all the currency in circulation has been deposited in banks. Well, don't these fellows know that the currency was to come back, after amnesty was declared, where people could pay about 50% as tax, 25% as deposit for 4 years without interest, and enjoy 25% remaining! So black money holders were actually given a chance to deposit all their black money, pay required income tax, and enjoy the remainder. Who will not avail it and throw away all 100% ?

Of course, now govt will have to strictly scrutinise deposits and ensure that penal provisions are invoked against those who dubiously tried to evade tax, by putting money in Jan Dhan and new bogus accounts etc. The govt need to go below Rs. 2.4 lakh deposits also if they appear suspicious, The govt announcement of no enquiry upto Rs 2.4 lakh cash deposit, was for those genuine tax paying citizens who kept some money in cash, by housewives etc. It was certainly not for crooks or cheats, who deposited cash in bogus accounts opened with connivance of corrupt bank managers. The govt should be ruthless, to retain the faith of common people, the cheats wont get away! The govt can certainly collect more than Rs. 2 lakh crores, through amnesty scheme and penal action against those who tried to cheat the system . Well those who are misleading the people by claiming it to be a failure, will certainly see the results, soon. Then they will cry foul on the ground that the govt is trying to harass innocent people who deposited their illegal ly earned money in good faith! Am sure the common and honest citizens will have the last laugh!

Disclosure in cases where vigilance proceedings are pending for long

RTI applications were filed concerning the alleged illegal allotment of sheds to a private firm in 2008 thereby causing a loss of Rs. 6.63 Cr. to the Govt. exchequer due to favouritism by the then Traffic Manager, Mumbai Port Trust. The PIO stated that the departmental vigilance proceedings are pending in the aforesaid context and the any disclosure of information would impede the process of prosecution of delinquent officers. The appellant drew the attention of the Commission towards the fact the cases relate to year 2008 and there is inordinate delay in the conclusion of investigation/ disciplinary proceedings. The CIC observed that merely because the process of investigation or apprehension or prosecution of offenders is continuing, the bar stipulated under Section 8(1) (h) of the RTI Act is not attracted. Moreover, a careful reading of the section reveals that the word used in section 8(1)(h) is "would" which implies that there should be definite material information in the hands of the CPIO to delineate that disclosure of the information will impede the process of investigation. Mere apprehension is not enough. If the intent of the legislature was to deny information on the basis of apprehension it would have used the word "could".

Comments

To the question whether details of ongoing proceedings against government employees can be disclosed, the Information Commission has not taken a generalized view. If the vigilance proceedings are pending for long duration, it defeats the very purpose of its initiation. In such situations, the accused may claim disclosure in larger public interest.
