"NAC papers - Politica, indica, corruptica"
Government's decision to release 710 files of NAC is welcome. An important
source material for historians, researchers, political analysts, journalists
etc to expose how legitimate powers of the executive were usurped by
an extra-Constitutional authority. Created in 2004 (UPA-I) and dissolved
on,2014 ( UPA-2) before PM Modi took over. Longest ever proxy rule by
the de facto ruler Consider some home truths about NAC's bizarre style
of functioning . Located in a 5-star office in Lutyen's Delhi, its chain
of command was carefully structured on need-to-know basis. Giving oral
directions was the unwritten rule. These were quickly legitimized by
the then de jure PM- who was richly endowed with pliability and a propensity
to retain his comfort zone. Though incorruptible, he was dishonest,
anyway.
Union secretaries used to be summoned direct to the NAC bypassing ministers.
The nervous bureaucrats shared their predicaments with successive Cabinet
Secretaries but without results. All hell broke loose. Scams after scams.
CWG, 2G,Coalgate, Choppers gate, Rober Vadra's illicit land deals etc.
Ottavio Quattrocchi,' great escape to Italy via London and Argentina,
was deftly manipulated. Permission to CBI officers to fly to London
to arrest Quattrocchi, was deliberately delayed to enable the culprit
reach Italy and avoid arrest. Thanks to the Screening committee of Secretaries
and the then Cabinet Secretary. Secretaries to the Chairperson NAC,
were retired secretaries, handpicked by the Congress supremo. They must
be questioned. All top appointments in GoI, PSUs and public sector banks
bore the informal ( unsigned ) approvals of the supremo followed by
signed legitimisation by de jure PM. The Prime Minister's Relief Fund
was blatantly misused by the de facto PM. Unfettered freedom to the
supremo, without an iota of accountability. Chairperson NSA acting as
super-PM, had prior access to all discussion papers before decision
by competent authorities. Quiz the then Principal Secretary, Secretary
or Joint Secretary to the then PM who carried files to NAC office for
seeking oral directions . In short, the NAC committed all illegalities
behind the screen. PM chose to turn a blind eye for a decade to remain
in power, citing "compulsions of coalitions"

Railway finances ?
I agree to disagree that Railway finances seem to be in quite a bad
shape and instead of improving these by recovering from the users, specially
the passengers, the cost of service they are thinking of ways to augment
the same in weird ways such as renting out platforms for weddings or
branding trains and stations. While branding may not be such a bad idea,
letting out Railway platforms for marriages is outright thoughtless.
This is to put the normal travelling public to inconvenience as also
expose the Railway facilities to insecurity as well as chaotic mess.
Even branding of trains and allowing the buying media or advertisers
to use the inside and outside of trains and stations with big hoardings
and posters on selling their products will spoil the ambience and exclusiveness
of rail travel. Now when the Rail Budget has been merged with the General
Budget and Railways get more Budgetary support besides not paying dividend
to General Revenue they should not hesitate to become really professional
in dealing with their finances. There could not be a better time for
them to do so when they have a minister who is above populism as he
has no constituency to serve and the Prime minister himself is taking
interest in Railway development and he has a big vision for that. Why
do they then hesitate to suggest raising of fares. If at all they have
to think of other ways of earning more income there could be so many
other imaginative ways. For example like running tourists' specials,
Pilgrimage specials or even marriage specials to destinations like Udaipur
etc. Sponsored visits for students and Railway buffs to hundreds of
heritage stations and other sites could be another idea. Unluckily there
are pinching points in railways which no one bothers to check (i) Maint.
cost at much inflated costs where railways contractors and engineers
are hand in glove (ii) purchase of railway repair parts and equipments
on papers and of inferior quality at inflated cost. (iii) Similarly
catering and allied services at inflated costs with very poor services.
If these are taken care of fares can be reduced to half. Are authorities
listening.

Disclosure in cases where vigilance proceedings are pending
for long
RTI applications were filed concerning the alleged illegal allotment
of sheds to a private firm in 2008 thereby causing a loss of Rs.
6.63 Cr. to the Govt. exchequer due to favouritism by the then
Traffic Manager, Mumbai Port Trust. The PIO stated that the departmental
vigilance proceedings are pending in the aforesaid context and
the any disclosure of information would impede the process of
prosecution of delinquent officers. The appellant drew the attention
of the Commission towards the fact the cases relate to year 2008
and there is inordinate delay in the conclusion of investigation/
disciplinary proceedings. The CIC observed that merely because
the process of investigation or apprehension or prosecution of
offenders is continuing, the bar stipulated under Section 8(1)
(h) of the RTI Act is not attracted. Moreover, a careful reading
of the section reveals that the word used in section 8(1)(h) is
"would" which implies that there should be definite
material information in the hands of the CPIO to delineate that
disclosure of the information will impede the process of investigation.
Mere apprehension is not enough. If the intent of the legislature
was to deny information on the basis of apprehension it would
have used the word "could".
Comments
To the question whether details of ongoing proceedings against
government employees can be disclosed, the Information Commission
has not taken a generalized view. If the vigilance proceedings
are pending for long duration, it defeats the very purpose of
its initiation. In such situations, the accused may claim disclosure
in larger public interest.
