NRI Conference : participation doubles
A big hit for NDA Govt. NRI participation is increasing every year.
If one compares with the UPA govt participation it has increased many
fold. More than 7000 registrations took place in recently held Bangalore
NRI Conference(Pravasi Bhartiya Divas Convention). According to sources
during UPA regime maximum registration was reported about 3000. Experts
see it NRIs attraction for Modi.

There is a great similarity between Donald Trump and Narendra Modi as
those because of whom they attained top posts are nowhere in their power
gallery. While in Modi's case LK Advani and Murali Manohar Joshi who
helped build the BJP are now simply 'Margdarshaks', in Trump's case
former Mayor of New York city Rudolph William Louis "Rudy"
Giuliani and Governor of New Jersey Christopher James "Chris"
Christie who helped him reach the coveted post are now not in his 'power
gallery'.

Sorry state of affairs
Hota became CMD of BEML on July 1, 2016. His previous post of Director
HR in BEML is still not filled up. Finance Director post is also vacant
for quite some time. God only knows who is delaying the filling up of
the two posts. Is it BEML or MOD or PESB. Hota was selected for CMD
somewhere in the beginning of 2016, that means the HR Director post
is now vacant for nearly one year, what a sorry state of affairs for
a major PSU like BEML.

Disclosure in cases where vigilance proceedings are pending
for long
RTI applications were filed concerning the alleged illegal allotment
of sheds to a private firm in 2008 thereby causing a loss of Rs.
6.63 Cr. to the Govt. exchequer due to favouritism by the then
Traffic Manager, Mumbai Port Trust. The PIO stated that the departmental
vigilance proceedings are pending in the aforesaid context and
the any disclosure of information would impede the process of
prosecution of delinquent officers. The appellant drew the attention
of the Commission towards the fact the cases relate to year 2008
and there is inordinate delay in the conclusion of investigation/
disciplinary proceedings. The CIC observed that merely because
the process of investigation or apprehension or prosecution of
offenders is continuing, the bar stipulated under Section 8(1)
(h) of the RTI Act is not attracted. Moreover, a careful reading
of the section reveals that the word used in section 8(1)(h) is
"would" which implies that there should be definite
material information in the hands of the CPIO to delineate that
disclosure of the information will impede the process of investigation.
Mere apprehension is not enough. If the intent of the legislature
was to deny information on the basis of apprehension it would
have used the word "could".
Comments
To the question whether details of ongoing proceedings against
government employees can be disclosed, the Information Commission
has not taken a generalized view. If the vigilance proceedings
are pending for long duration, it defeats the very purpose of
its initiation. In such situations, the accused may claim disclosure
in larger public interest.
