Demonetization 50 days - 21 facts

1. Government is Alert & active, Manipulations are not easy now

2. Government has shown us that we all are dependent on each other

3. Indian families proved very good savers for which we are known all over

4. Somehow Judiciary is very much liking the Government's working style, but can't quote due to their limits

5. Obliging is in our blood, Bank Managers have proved it. (only 1% bankers were money minded , rest were helpless if we see their incoming calls)

During Mahabharata era the politics of thumb begins. Dronacharya took the thumb of Eklavya and made him skillless so that Arjuna can rule. All previous rulers in the country made people use their thumb instead of pen ( symbol of literacy) so that they can rule them. Here comes the king who changed the symbolism by using the same thumb for the empowerment and upliftment of poor. Soon comes the day when poor can show their thumb to the corrupt. Cashless India thumbs up !

DATE WITH RTI

Disclosure in cases where vigilance proceedings are pending for long

RTI applications were filed concerning the alleged illegal allotment of sheds to a private firm in 2008 thereby causing a loss of Rs. 6.63 Cr. to the Govt. exchequer due to favouritism by the then Traffic Manager, Mumbai Port Trust. The PIO stated that the departmental vigilance proceedings are pending in the aforesaid context and the any disclosure of information would impede the process of prosecution of delinquent officers. The appellant drew the attention of the Commission towards the fact the cases relate to year 2008 and there is inordinate delay in the conclusion of investigation/ disciplinary proceedings. The CIC observed that merely because the process of investigation or apprehension or prosecution of offenders is continuing, the bar stipulated under Section 8(1) (h) of the RTI Act is not attracted. Moreover, a careful reading of the section reveals that the word used in section 8(1)(h) is "would" which implies that there should be definite material information in the hands of the CPIO to delineate that disclosure of the information will impede the process of investigation. Mere apprehension is not enough. If the intent of the legislature was to deny information on the basis of apprehension it would have used the word "could".

Comments

To the question whether details of ongoing proceedings against government employees can be disclosed, the Information Commission has not taken a generalized view. If the vigilance proceedings are pending for long duration, it defeats the very purpose of its initiation. In such situations, the accused may claim disclosure in larger public interest.
