M: And I don't understand...... if Akhilesh wants to project himself as the Neta for UP's Youth then why the hell is he fighting for the Cycle Symbol… he should make the Mobike his symbol….and change his Party's Color too….. could be Blood Red....
RF: Ha ha….. Pehlwan Dimaag … after all he comes from a Family of Pehelwans…. adh gaya toh adh gaya!!! And Modi's rally in Lucknow is not in response to the Family Feud… this rally was planned quite some time back….and kick starts his UP Campaign…
M: And as the Model Code of Conduct I think Modi will make some Farm related sops soon…..though I think Modi's plank will be ....get the rule of Law back into UP...progress and development need Rule of Law...
RF: I think he should roll back the Excise on Fuel ….the Excise was raised at the start of the Fuel windfall days….
M: Maybe it'll be done very near the UP Polling….and it is not covered by the Code of Conduct guidelines….
RF: Just saw the pics from Modi's Parivartan Rally…. the attendance is humongous…. I don't think even Mayawathi has been able to get such a response …. despite this being her turf….not even if 2 of her Rallies were clubbed together ....
M: So now Mayawathi will up her ante against Modi…. after all the UP Battle is between BJP and BSP….
RF: This reminds me Mamtha too is unrelenting ….sometimes I get the feeling that her hatred for Modi is so much.... and knowing Modi is here to stay for some time … so she looks like a proponent of United States of India….anything the Centre does she objects…she even objected to the raids on TN CS.....
M: I think Mamtha has this wrong notion that she's PM material….. it will be a nightmare for India if it happens … though lesser than if Rahul become PM… that would be a catastrophe….it's the worst of worst scenario's for India….
RF: I hope the SC's Judgment not to use Religion to Politick will reign in Political Parties … SC has just formalized a unwritten rule of Sane Societies…...
M: Speaking about SC …. BCCI is in a tizzy…
RF: Good….. rule of these so called Sports Administrators should end….. BCCI is a goldmine and some Netas would prefer to be in the BCCI rather than in active Politics ….. and do keep in mind who mentored the Financial Clout of BCCI….
M: I'm sure BCCI Bosses must be wondering if there is some way to refer SC's verdict to a 'Third Umpire'…..

"Selection of Director, CBI"

The CBI has received replies in response to its Letter Rogatory in connection with the Augusta Westland VVIP chopper case, from all eight countries : UAE, Singapore, Mauritius, Tunisia, Italy, British Virgin Island, the UKand Switzerland. The CBI will have to re-start quizzing on the basis of fresh inputs.
Rakesh Asthana is the interim Director, CBI. Selection of the regular incumbent by a three members committee headed by the PM with CJI and LOP (LS) as members, is underway.
LOP (LS) is a Congressman. The scam was perpetrated during UPA era. Will it be ethical to associate the present LOP (LS) with the selection process? Will this not lead to a travesty of Justice ?

Only parallel cash economy can balance economy


1.10% people are employed in Government and in private on monthly salary basis regularly and invest regularly in various schemes and in cashless hitech style and the way government wants.
2.Balance 90% are self employed and earn on daily basis and spend full on daily basis.
If government wants them to follow as they want, then government have to create job and businesses first and if they can not, better government study first which they have not.
Therefore no scheme can work out until and unless- all 90% are regularised and have monthly salary.
And for this government has to creat business and jobs and it is not possible and out of question.
Government should forget and forgive their taxes as people are not enjoying any subsidies and facilities.
People are doing the job of government by creating business and jobs at their own risks and charging so that cycle is continued.
Our economics of country is based on small doings. If government interferes everywhere, this is going to increase extra expenses or people may loose their jobs even and by this all will be burden on the government.
By this people are doing the job of government in less cost.
Government should not take in this way that people are not paying taxes and income is being concealed. Only parallel cash economy can balance the economy of our country.

Why can't IAS officers be raided like central govt officers ?


It's really ironic that whenever the Enforcement agencies raid or trap IAS officers they start crying fowl as if they alone are above law .the recent incident of a raid by the Income Tax in the residence of Tamil Nadu CS is one example . He declares, It's a raid against the state as if he is LOUIS XIV who declared "L'État, c'est moi" I am the state . There have been action against the most senior officers of other services like years ago, on the then Chairperson CBEC, B P VERMA , Railway Board members etc but no one cried 'I am the state' . This shows that the IAS which already has grabbed all cakes of bureaucracy still thinks itself to be above law and unfortunately our system makes them believe so. There is no equality before law. It's a dead concept, it seems.

Disclosure in cases where vigilance proceedings are pending for long

RTI applications were filed concerning the alleged illegal allotment of sheds to a private firm in 2008 thereby causing a loss of Rs. 6.63 Cr. to the Govt. exchequer due to favouritism by the then Traffic Manager, Mumbai Port Trust. The PIO stated that the departmental vigilance proceedings are pending in the aforesaid context and the any disclosure of information would impede the process of prosecution of delinquent officers. The appellant drew the attention of the Commission towards the fact the cases relate to year 2008 and there is inordinate delay in the conclusion of investigation/ disciplinary proceedings. The CIC observed that merely because the process of investigation or apprehension or prosecution of offenders is continuing, the bar stipulated under Section 8(1) (h) of the RTI Act is not attracted. Moreover, a careful reading of the section reveals that the word used in section 8(1)(h) is "would" which implies that there should be definite material information in the hands of the CPIO to delineate that disclosure of the information will impede the process of investigation. Mere apprehension is not enough. If the intent of the legislature was to deny information on the basis of apprehension it would have used the word "could".

Comments

To the question whether details of ongoing proceedings against government employees can be disclosed, the Information Commission has not taken a generalized view. If the vigilance proceedings are pending for long duration, it defeats the very purpose of its initiation. In such situations, the accused may claim disclosure in larger public interest.
