Who will become DG NHRC ? (UPDATED)
The Government is in a fix as no IPS officer is willing to join as DG NHRC. But because of SC directive GOI is bound to appoint a DG in NHRC this week. If sources are to be believed govt is likely to appoint either Anil Kumar a WB cadre 1982 batch IPS or Ms Neelami Raju, a Karnataka cadre 1983 batch IPS officer to the post. If Kumar is appointed he will have only three months to serve.

If the finance minister really raises IT exemption limit, it will help Modi overcome the tag of a TAX -terrorist as the middle class sees him only targeting them rather than look for Switzerland or well known offenders like Mallya or Lalit Modi. Unfortunately, UP and Punjab elections too are knocking at the doors where the tax terrorism has already created substantial ill -feelings in the traditional BJP vote bank.

Filing of RTI Application to know the fate of earlier application

An application was under the RTI Act seeking information regarding action taken on an earlier RTI application and first appeal filed by the Complainant. A reply was sent to him on but the Complainant stated that he did not receive this reply. The Respondents volunteered to send another copy to him. While noting that no further action is due on this RTI application, the CIC observed that the right course of action for an RTI applicant, in the event of the PIO not responding to his RTI application, is to file an appeal to the First Appellate Authority and thereafter, if necessary, an appeal / complaint to the Commission. Instead, the Complainant took upon himself to enquire into the delay on the part of the Respondents in responding to his earlier RTI application by filing yet another RTI application. Filing of such applications is avoidable because the RTI Act provides for appeals / complaint process in the event of unsatisfactory action by Respondents on an RTI application. Such applications needlessly clog the system.

Comments

RTI act is a self contained act which provides for the mechanism to deal with cases where replies have not been received. An applicant should use the modalities provided under the Act which can provide him the best results.
