Jaishankar to get extension?
It seems certain, in view of continuity present Foreign Secretary S Jaishankar is going to continue in service beyond January 28 when his two-year tenure comes to an end. He is sure to get one year extension? He is a 1977 batch IFS officer.

Will meeting to select CBI Chief be held on January 12?
Now meeting to select new CBI Chief is scheduled to held on January 12. Will the meeting take place? In fact the Government has sought vigilance clearance from the states for 42 IPS officers eligible for the post. Will the vigilance clearance of all the 42 officers belonging to 1979 to 1982 batch will reach before January 12?


Tug-of-war between Centre, WB over fixing tenure of DGP

A conflict between Government of India and West Bengal Government may spark off over the continuation of present incumbent 1985 batch IPS officer Surajit Kar Purkayastha after his retirement on December 31. The Trinamool Congress Government fixed the tenure of Purkayastha for a period of two years as per court orders while Centre is against it.

MHA not allows IPS officer continue in cadre after retirement
The Ministry of Home Affairs (MHA) will not allow any IPS officer from continuing in office after retirement in the cadre, unless it has been cleared by the Centre. Some State Governments are continuing services of IPS officers after retirement.

Comments make no sense

The comments of tyrani did not make sense to me. What does he imply! Where he got this figure of 10% and 90%? About Sunil, I don't understand his logic. He is perhaps unaware that law is same for all services, allied services and all India services. If an accused says anything to keep himself relevant, how does it become the attitude of IAS! Has the IAS association given any statement! Let us not dwell only on perceptions! Let us be analytical and contribute what we can in nation's interest. Not self or service rivalries!

Disclosure in cases where vigilance proceedings are pending for long

RTI applications were filed concerning the alleged illegal allotment of sheds to a private firm in 2008 thereby causing a loss of Rs. 6.63 Cr. to the Govt. exchequer due to favouritism by the then Traffic Manager, Mumbai Port Trust. The PIO stated that the departmental vigilance proceedings are pending in the aforesaid context and the any disclosure of information would impede the process of prosecution of delinquent officers. The appellant drew the attention of the Commission towards the fact the cases relate to year 2008 and there is inordinate delay in the conclusion of investigation/ disciplinary proceedings. The CIC observed that merely because the process of investigation or apprehension or prosecution of offenders is continuing, the bar stipulated under Section 8(1) (h) of the RTI Act is not attracted. Moreover, a careful reading of the section reveals that the word used in section 8(1)(h) is "would" which implies that there should be definite material information in the hands of the CPIO to delineate that disclosure of the information will impede the process of investigation. Mere apprehension is not enough. If the intent of the legislature was to deny information on the basis of apprehension it would have used the word "could".

Comments

To the question whether details of ongoing proceedings against government employees can be disclosed, the Information Commission has not taken a generalized view. If the vigilance proceedings are pending for long duration, it defeats the very purpose of its initiation. In such situations, the accused may claim disclosure in larger public interest.
