Me: Now they say Akhilesh is in talks with Congress….. whatever you multiply by naught ends up as naught…. isn't it!!!!
Respected Friend: All scripted …… Dad firing son….. Son hijacking the Party…….Father shamming illness….. Son saying Father is still his Leader….. Son talking to Congress….. actually this talk with Congress would have taken place some time back…..cannot be an overnight development! And now soon Father and son will make-up!!!
M: So the objective is to project Akhilesh as a Leader and one who can form alliances…. but if all is honky-dory again there has to be a fall guy…
RF: Amar Singh…… another drama or royal boot .... Akhilesh does not like him and neither does Congress……
M: So now Rahul has to return from his overseas trip for the next Act of this Drama…. What about the Budget????
RF: When an early Budget was proposed Opposition were okay with it….did they not know then that Elections for UP would be held around this time….my feeling is if they could they'd stop the Budget from being presented…. they know this is going to be a path-breaking Budget…. has to be!!!!
M: But they say Congress in 2012 agreed to delaying the Budget for elections ....
RF: I think because of the listless Budget that was going to be presented because of the prevailing circumstances then I think Congress was only too happy to accommodate…. In fact if the Budget had been presented would have been detrimental for Congress….
M: And before EC announced the Dates it was aware of the Budget…. it is not as if the Budget date was announced after the EC announced the Dates… what's wrong with Mamtha!!!
RF: I read in a Financial Newspaper that after Demonetization was announced she simply lost it!!!
M: And she's gotten just bad to worse…..
RF: And TMC is very much like Congress….. no one can question Rani in Congress and Didi in TMC!!!!!
M: Now Kejri says that AAP removed the list of Donors from its Website for fear of Donors being harassed by BJP….
RF: So he's justifying Anonymity in Political Donations…. he was the one who used to keep on yelling that BJP should make list of its Donors Public…..
M: His Key Aide now says he was being harassed by CBI to name Kejri and so he's resigned from service….
RF: Let me be the Devil's Advocate….maybe seeing the Buck move upwards he decided to do this so as show CBI is biased against Kejri… Chess khel raha hai ....
M: Seems BJP's doing well in in UP..UK... Goa ....but seems to be on back foot in Punjab ...
RF: Punjab has always been a difficult election to call... why even a Neta like Amrinder who was in the forefront last time too got it wrong ...thinking that by noon Congress would have taken a decisive lead he called Journos for Coffee with Captain. ..at Noon viewing the results only a few of his Favourite Journos turned up ...for Tears with Captain ...chalo let's settle the Tab ...I got to do some shopping ...again today you do the honors ....Joke for the road ...

Very mature response on Demonitization ! So many parodies and jokes are circulating. It must be a closed mind that does not appreciate the different dimensions. What started as a grand scheme has gone off the rails. Unfortunately, like we cannot watch a banana grow ripe, we cannot also fathom the effects of this on the economy, which will have its impact in a year to two. But then people will resort to the "bulb in the refrigerator syndrome" - you cannot say if the bulb inside is off when the fridge is shut, but when you open it, it is ON. So is this irreversible step on demonitization.

Disclosure in cases where vigilance proceedings are pending for long

RTI applications were filed concerning the alleged illegal allotment of sheds to a private firm in 2008 thereby causing a loss of Rs. 6.63 Cr. to the Govt. exchequer due to favouritism by the then Traffic Manager, Mumbai Port Trust. The PIO stated that the departmental vigilance proceedings are pending in the aforesaid context and the any disclosure of information would impede the process of prosecution of delinquent officers. The appellant drew the attention of the Commission towards the fact the cases relate to year 2008 and there is inordinate delay in the conclusion of investigation/ disciplinary proceedings. The CIC observed that merely because the process of investigation or apprehension or prosecution of offenders is continuing, the bar stipulated under Section 8(1) (h) of the RTI Act is not attracted. Moreover, a careful reading of the section reveals that the word used in section 8(1)(h) is "would" which implies that there should be definite material information in the hands of the CPIO to delineate that disclosure of the information will impede the process of investigation. Mere apprehension is not enough. If the intent of the legislature was to deny information on the basis of apprehension it would have used the word "could".

Comments

To the question whether details of ongoing proceedings against government employees can be disclosed, the Information Commission has not taken a generalized view. If the vigilance proceedings are pending for long duration, it defeats the very purpose of its initiation. In such situations, the accused may claim disclosure in larger public interest.
