IPS Dr. Jitendra Kumar Yadav’s Fight to End Naxal Terror in Bijapur, Chhattisgarh

IPS Dr. Jitendra Kumar Yadav is a 2018 Batch Officer of Chhattisgarh cadre and is currently posted as Superintendent of Police, Bijapur-one of the most Naxal affected districts in the state. His mission for the district is to aggressively fight against Naxalism and minimize the displacement of villagers.
 
“We are trying to fight Naxalism in an aggressive way because, if we are delaying this problem, then more people are suffering, ” he said.
 
Bijapur has a highly organised Naxal network in the region, and recruitment is also high, adding to the challenge. Explaining the scope, Dr Yadav said“ Over the last three months alone, we’ve recovered nearly 200 IEDs, 25 of which exploded, resulting in the deaths and injuries of several jawans”
 
To tackle all this, a multipronged strategy is adapted—operations, arrests, and rehabilitation. Security forces are conducting operations to arrest or neutralise militants. The second part is arrest, those who are left behind after encounters or are unarmed are taken into custody.
 
The third component of the approach is surrender. Under this as per the state policy, rehabilitation and skill development programs are provided. “At present, 90 surrendered Naxals are undergoing skill training, and accordingly, we will provide them jobs ”he explained.
 
Apart from this, Dr Yadav mentioned the role of camps in bringing positive change. “We’ve established nearly 20 security camps in interior areas where there were no roads, electricity, or basic infrastructure. This has made a huge difference,” he said.
 
Through these camps, the aim is to make villages more accessible, development unanimous and enhance security. “Many villagers have been forced to abandon their homes. They own 5, 10, even 50 acres of land, but cannot return because the Naxals don’t allow it. Either you support them, or you’re forced out. ”He said
 
Recalling an emotional moment from his journey, Yadav shared, I met an elderly woman .She told me, ‘I have just one wish—I want to go back to my village and die there.’
 
With a strong commitment,Dr Yadav is determined to restore peace and help people reclaim what is rightfully theirs.

As per indications, the name of Parag Jain is doing the rounds for the post of next Secretary, Security. He is a Punjab cadre 1989 batch IPS officer and presently posted in RAW as Special Director.

Mumbai Police Commissioner’s appointment: CM Maharashtra on a mission?

Devendra Fadnavis, the Chief Minister of Maharashtra since December 2024, when he assumed the charge, appears to be a man on mission. He - who also holds Home Department - is appointing result-giving officers at the key positions. The latest such appointment was witnessed in the posting of Mumbai Police Commissioner. The Chief Minister picked 1994-batch IPS officer Deven Bharti for the position. Bharti has worked on many high profile cases, including the 26/11 Mumbai attacks, and is seen to have a good rapport with Fadnavis. In the first meeting after returning to the Chief Minister’s Office (CMO), Fadnavis had made it clear to the bureaucracy that his Government’s roadmap needed to be implemented in the given timeline while also telling his officers that they would ‘perish’ if they did not ‘perform’. On December 9 last year, just four days into his latest tenure, he has appointed Shrikar Pardeshi as his Secretary. A 2001-batch IAS officer, Pardeshi worked with him even when Fadnavis was the Deputy CM between 2022 and 2024 in the Eknath Shinde Cabinet. Pardeshi earlier served in the Prime Minister’s Office (PMO) between 2014 and 2020. On December 14 last year he has appointed 1995-batch IAS officer Ashiwni Bhide as the Principal Secretary in the Secretariat. She had served as the Mumbai Metro Rail Corporation Chief during the NDA’s first term (2014-2019).

 

Extension of Karnataka DGP’s tenure is likely to benefit officers to follow?

The Karnataka Government has extended the service tenure of the DG&IGP Alok Mohan up to May 21 to ensure a minimum of two years’ tenure. This will become a precedent, and those who follow Alok Mohan as Heads of Police Force (HoPF) in Karnataka, but have less than two years’ service left from the date they take charge, will likely benefit from this move. This is the first such case in the State, informed a senior IPS officer, who does not want to name him. Tenure of a minimum of two years was part of the guidelines laid down by the Supreme Court in the Prakash Singh case that led to Police reforms in the country. Mohan took charge as in-charge DG&IGP of the state Police on May 21, 2023. His appointment was confirmed on August 5, 2023. The state Government has now considered May 21, when he took charge as in-charge DG&IGP to calculate a two-year tenure.

When can repetitive RTI Applications be termed as misuse of RTI Act?

Statement of Account and other related information was sought by the appellant. The PIO replied that the Query was not clear and seeking confirmation does not fall under the purview of ‘information’ as defined under Section 2(f) of the RTI Act. Further, you are filing continuous RTI Applications one after another which is clear misuse of provisions of RTI Act. A Recovery Suit has been filed against you by the bank, and the information being sought is to mislead the undersigned. Such action shall disproportionately divert the resources of the public authority under Section 7(9) of RTI Act. Moreover, it is also observed that seeking information on behalf of Company without Resolution passed by the company is not as per the Provisions of RTI Act. In the second appeal, the CIC observed that even if the infirmities contained in the RTI queries under reference is accepted, it is irksome to note that some of the arguments of the Respondent are in excess of the mandate of the RTI Act, particularly in the context of over emphasizing on the pending recovery suit or that the Appellant could access records through a different channel etc. The CIC cautioned the Respondent that the PIO ought to restrict themselves to the definition of information as envisaged under Section 2(f); the Section 8 exemptions as well as availability/unavailability of information. Any rejection of a RTI Application ought to be strictly premised on the applicable provisions of the RTI Act and RTI Rules, 2012 alone and not any other extraneous considerations. In cases where the CPIO seeks to rely on arguments like repetition and misuse of RTI Act, then allegations of such magnitude ought to be sufficiently supported with relevant proof in terms of details of past record of RTI Applications and Appeal(s) and the replies provided thereupon or atleast any reference of decisions issued by the CIC in matters of the same Appellant with respect to the same public authority.

Comments

Some PIO’s tend to reject RTI application on grounds which not specified under the RTI Act. In many instances, the PIO is rejecting the application as being repetitive and therefore, amounting to misuse of the RTI Act. As this case provides the guidelines for such occurrences, it would be highly relevant for the PIOs.
